Terms of Service

These terms of service are the agreement between you and Kaviyan for the Kaviyan AI video editor, this website and work booked with Kaviyan Studio. By creating an account or booking studio work, you accept them. If you accept for a company, you confirm that you may bind it.

1. Your account

You need an account to use Kaviyan. Give accurate details, keep your sign-in details safe and tell us straight away if you think someone else has used them.

• You must be old enough to enter a contract where you live.

• The workspace owner is responsible for the people they invite and for activity in the workspace.

• Each seat is for one person. Do not share a login.

2. Plans and billing

Kaviyan comes in four plans: Free, Creator, Studio and Scale. What each plan includes, and what it costs, is set out on the pricing page at the time you subscribe. The Free plan has no time limit.

• Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled.

• You can cancel at any time. Access continues until the end of the paid period, then the workspace moves to Free.

• Your first payment on a paid plan can be refunded in full within 14 days. Later payments are not refunded, except where the law requires it.

• Prices exclude tax unless stated. We give at least 30 days of notice before a price change applies to you.

• If a payment fails, we tell you and try again. After 14 days without payment, paid features pause.

3. Ownership of your uploads and outputs

You own everything you upload to Kaviyan: footage, project files, audio, brand kits and templates. You also own what the agents make for you, including rough cuts, grades, mixes, titles and the shots Nova generates, as far as the law allows such work to be owned.

You give us a limited licence to host, process and display your content, only so that we can provide the service to you. The licence ends when you delete the content or close your account. We do not use your content to train AI models unless a workspace owner opts in, as the Privacy Policy explains.

What you are responsible for

You confirm that you have the rights to what you upload, including music, footage and the likeness of the people in it. Generated shots can resemble work made for other customers from similar prompts, so review each output before you publish it.

4. Acceptable use

Do not use Kaviyan to break the law, infringe someone else’s rights or disrupt the service for others. In particular:

• No content you do not have the right to use.

• No generated video that impersonates a real person without consent, or that is made to deceive.

• No unlawful, hateful or exploitative content.

• No attempts to reverse engineer, overload or bypass the service or its limits.

• No reselling of access without a written agreement.

We may remove content or pause an account that breaks these rules. Where we can, we tell you first and give you time to fix it.

5. Studio engagements

Work by Kaviyan Studio is governed by these terms and by a written scope. The scope sets the deliverables, the fixed price, the dates and the review points. If the two documents disagree, the scope wins.

• Fees are fixed for the agreed scope and invoiced as the scope states.

• Reviews run on the schedule in the scope. Feedback sent within the agreed time keeps the dates.

• You provide the footage, brand assets and approvals the work depends on.

Handover and ownership

At handover, once the final invoice is paid, you own every deliverable: project files, blocks, templates and exports. We hand over all working files with recorded walkthroughs. We show finished work in our portfolio only with your written approval.

Changes and cancellations

Changes to a scope are agreed in writing before extra work begins. Either side can end an engagement with seven days of notice. Work completed up to that date is billed, and its files are handed over.

6. Kaviyan’s intellectual property

The product, the agents, our stock blocks and templates, and the Kaviyan brand belong to Kaviyan. Your plan gives you the right to use them while it is active, not to own them. If you send us feedback, we may use it to improve the product without owing you anything for it.

7. Availability and support

We work to keep Kaviyan available around the clock and announce planned maintenance in advance. The agents depend on your editing software and your connection, which we do not control. Support channels and response times depend on your plan. Features marked as beta may change or be withdrawn.

8. Warranties and liability

We provide Kaviyan with reasonable skill and care. The agents draft and you decide: every cut, grade and generated shot stays editable, and you are responsible for reviewing work before you publish it. We do not promise that outputs will be free of errors or fit a particular purpose.

To the extent the law allows, neither side is liable for indirect or consequential loss, and our total liability for any claim is limited to the fees you paid us in the twelve months before it arose. Nothing in these terms limits liability that cannot be limited by law, or the rights you have as a consumer.

9. Suspension and termination

You can close your account at any time from your workspace settings. We may suspend or close an account that breaks these terms, puts the service or other customers at risk, or stays unpaid.

• Where we can, we give notice and a chance to put things right first.

• After an account closes, your content is kept for 30 days so you can export it, then deleted as the Privacy Policy describes.

• The sections on ownership, fees owed and liability continue after the agreement ends.

10. Changes to these terms of service

We may update these terms as the product changes. If a change is material, we email workspace owners at least 30 days before it takes effect. If you keep using Kaviyan after that date, you accept the new terms. If you do not agree, you can cancel before it applies.

11. Governing law and contact

These terms are governed by the laws of the country where Kaviyan is established, and its courts settle any dispute, unless consumer law where you live gives you other rights. We would rather solve a problem directly, so write to us first.
